Federal Judges Rule in Favor of Drag Shows

April 1, 2025

Federal judges are ruling in favor of public university drag shows and drag shows targeting minors despite pushback from the public.

The Texas A&M Board of Regents banned their annual drag show that the University’s Queer Empowerment Council held every year since 2020.

After the Council sued Texas A&M, Houston-based U.S. District Judge Lee Rosenthal ruled in favor of the Council, claiming that banning drag shows “because it offends some members of the campus is precisely what the First Amendment prohibits.”

Texas A&M worries that allowing the drag show will jeopardize federal funding because it does not align with President Trump’s Executive Order, which bans universities that spread harmful gender ideologies from receiving federal funds. Judge Rosenthal argued that the university is not funding the show; they are just allowing it.

Similarly, the Montrose Center in Houston which supports the LGBT agenda and is a non-profit supported by taxpayers is hosting a drag show to celebrate “Transgender Day of Visibility” that will be open to all ages.

They made it clear that this event is directed at children. Federal Judge David Hittner ruled against a Texas law that bans sexually explicit performances in the presence of minors and ruled in favor of the American Civil Liberties Union which allows drag queens to continue performing drag shows for children.

The U.S. Fifth Circuit Court of Appeals is currently considering an appeal filed by Texas Attorney General Ken Paxton. Hopefully, the higher court will move to overrule Judge Hittner.
